It is our aim to make your visit to our farm a beautiful experience that you will treasure for many years to come and wish to repeat time and again. We ask that you read and accept the following terms and conditions which must be complied with by all persons visiting Conies Farm Shepherd's Hut as a guest. These enable us to maintain our standards, to assist in proper management and ensure your safety as well as establishing a clear legal contract for cancellation, damage and exceptional circumstance. These conditions set out the basis of the holidaymaker’s contract (the guest) with Conies Farm Shepherd's Hut (CFSH). The contract is effective once the required deposit payment has been received from the guest.
Booking
Requested bookings are all subject to availability. When you submit a booking request via the website, by post or by phone, you will receive an automatically generated summary e-mail to the e-mail address you provide in the booking form. This does not form a contract. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent by post or e-mail and when deposit payment is received. CFSH has the right to refuse any booking, for whatever reason prior to issuing the guest with written confirmation. The party leader must be at least 21 years of age at the time of booking. Please check all booking details carefully and inform CFSH of any incorrect information immediately. The guest books the holiday as the consumer and therefore agrees that no liability can be accepted by Conies Farm Shepherd's Hut for any expenses, costs, losses, claims or other sums of any description which relate to any business suffered or loss incurred.
Payment
For bookings made less than 8 weeks in advance, the total amount is payable. If a booking is made more than eight weeks before the holiday is due to start, a non-refundable deposit of 30% of the rental cost must be paid. The full balance of the total holiday cost is payable to CFSH not later than 8 weeks (56 days) before the arrival date. If the balance is not paid, CFSH reserves the right to cancel the holiday booking, in which case the deposit will be forfeit. NB. No reminders will be sent out beyond the booking confirmation. Payment may be made payable to Conies Farm Shepherd's Hut by sterling cheque, PayPal or by bank transfer to…Sort Code 07 04 36 Account No. 04591096. Sterling cheques are to be made payable to A. Acton with the booking reference, long card number and card expiry date written on the reverse of the cheque. At the point of receiving the first payment, a confirmation e-mail will be sent and the booking will be confirmed. Any charges raised against CFSH by the guest's bank for handling dishonoured cheques, bank transfers or any other payments will be passed on to the guest who will be liable to reimburse CFSH in respect of such charges within seven days. Any charges incurred in handling payments from overseas will be passed on to the guest.
Security Deposit for breakages and damage
A refundable security deposit of £200 is to be paid against any breakages or damage to the property. This will be refunded without interest within 14 days of the guest's departure from the property, less any deductions for damage. Any charges incurred in refunding deposits to overseas accounts will be passed on to the client.
Cancellation by guest
Once a booking is confirmed, i.e. the deposit has been paid and the booking accepted, the guest is responsible for the total cost of the holiday as shown on the invoice. We therefore strongly recommend that you take out holiday cancellation insurance with your insurance broker. If the guest has to cancel their holiday they must notify CFSH immediately in writing to This email address is being protected from spambots. You need JavaScript enabled to view it.. This notification of cancellation can only be accepted from the party leader. If notice is received more than 8 weeks from the start of the holiday, the deposit amount (30%) will be forfeit. If the guest cancels less than 8 weeks from the start of the holiday, the guest is liable to pay for 100% of the holiday cost. CFSH will do its best to re-let the property booked and, if successful, the guest's liability for the balance of rental beyond the 30% deposit will cease. If CFSH has not been successful in re-letting the property the guest remains liable for the full cost of the holiday. If the guest does not pay the amount due in relation to the booking by the due date (NB. no reminder will be sent) CFSH will assume that the guest wishes to cancel the booking, in which case CFSH will be entitled to keep all of the deposit already paid.
Cancellation by Conies Farm Shepherd's Hut
Extreme Conditions: CFSH reserves the right to cancel a holiday in light of extreme conditions of weather, terrorism or war. In any of these very unlikely circumstances full payment will be returned to the guest. Emergency Contingency: CFSH reserves the right to cancel a holiday at short notice if for unforeseeable circumstances they are unable to provide safe accommodation due to extreme conditions, ill health, fire or administration or any other extenuating circumstance. Under such circumstances full payment will be returned to the guest. CFSH cannot accept liability or responsibility for any loss, including consequential loss caused by cancellation.
Booking alterations
Any alterations to a booking by the guest may be subject to an administration charge of £25. Any change in holiday dates will also be treated as a cancellation unless otherwise agreed to with CFSH. If, for unforeseeable reasons, CFSH has to cancel the holiday booking, all monies paid in advance by the guest will be refunded in full, and the guest shall have no further claim against CFSH.
Booking errors
Whilst every effort will be made to avoid them, booking errors made by CFSH will not in any circumstances be compensated for unless there is less than 8 weeks until the booking dates commence. If there is less than 8 weeks until the booking date commences CFSH's liability will be limited to the return in full of any monies paid.
Prices
Prices quoted on the website and in marketing materials include VAT. CFSH reserves the right to charge the guest any increases in VAT.
Arrival and Departure
Bookings are from 4.00pm on Friday and 6.30pm on Tuesday, Wednesday and Thursday on the day of arrival to 10am on the day of departure, except Sunday's which are 11am checkout. Timing on winter bookings and short breaks is flexible subject to prior agreement with CFSH. Guests are asked to leave their accommodation clean and tidy and in the same condition as they found the huts on arrival when vacating. Guests are asked to give consideration to residents of the farmhouse and not to cause nuisance or annoyance. CFSH reserves the right to gain access with prior notice for the purpose of maintenance and inspection if it is necessary.
Liabilities
Conies Farm is a working farm with live animals and other hazards. The farm is a wonderful place for children to play but parents or guardians are responsible for them at all times. Children must not play un-supervised anywhere on the farm. The guest may with the farmer's permission visit the farmyard but only under full supervision by a parent or guardian. Some of the camp equipment can be dangerous if misused. The fire guard (provided) must always be used when the wood burning stove is lit and children must be fully supervised around the stove at all times. CFSH will not be responsible to the guest at all, whether in contract, tort (including negligence), breach of statutory duty, restitution or otherwise for any injury, death, damage or direct, indirect or consequential loss (all three of which terms include without limitation pure monetary loss, loss of profits, loss of business or revenue, depletion of goodwill, lost expectation, loss of savings, lost data and similar loss) however caused arising from or in connection with the use of the facilities at CFSH including any computer virus.
Damage and losses
It is the guest's responsibility to close windows and lock the Shepherd's Hut when they are not on site. CFSH cannot be held responsible for the guest's personal property which is not locked away inside the hut. Guests bringing their own bicycles should ensure they are locked and left outside the hut, please bring locks with you. CFSH cannot be held responsible for damage or theft to bicycles left on the property. Bicycles are not permitted inside the Shepherd's Hut.
Disabilities
We advise that any guests with limited mobility contact CFSH prior to booking as access to the Shepherd’s hut and Dining hut is only possible via 3 steps with handrails.
Number of Guests and unsuitability
The maximum number of guests permitted in the Shepherd’s Hut must not exceed the number stated on the booking form. Additional tents are not permitted beyond the tent stated on the booking form other than by prior agreement with CFSH at time of booking. CFSH reserves the right to decline accommodation and to order any unauthorised person off the premises. CFSH reserves the right to refuse any booking which, in its opinion, is unsuitable for the property.
Day Visitors
Day visitors are welcome by prior agreement with CFSH, although the facilities are for the sole use of the residents.
Damage and Breakages
The guest is responsible for leaving the accommodation in good order, clean and tidy and in the same condition as they found the hut on arrival when vacating. The guest further undertakes to pay for any damage or losses incurred during occupation or any extra cleaning costs incurred, these will be deducted from the £200 security deposit, or more if the repair costs exceed this amount. Please alert CFSH as soon as is reasonably possible of any damage or breakages. CFSH reserves the right to repossess the property if excessive damage has been caused by the guest or a member of the party.
Shepherd’s hut and Dining Hut Structure
It is prohibited to interfere with or adapt the structure of the Shepherd's Hut or Dining hut in any way.
No Fire Policy
Fires are restricted strictly to the wood burning stove only.
No Smoking Policy
The Shepherd's Hut and Dining Hut are NO SMOKING PROPERTIES. Smoking is strictly prohibited inside the huts. Failure to comply will result in an additional fee of £400 to cover deep cleaning and re-decoration. Any guests smoking outside of the hut are responsible for disposing of their cigarette butts in a bin and must not litter the surrounding area.
Pets
Well-behaved dogs are welcome by prior arrangement at the time of booking. Dogs must be kept on a lead at all times when not within the confines of the orchard paddock. CFSH respectfully asks that any dog foul is to be collected up by the guest and disposed of in the bin provided. Dogs must not be left in cars or in/around the hut on the farm if guests have gone out. Guests must provide their own basket or bedding for dogs to sleep on. Dogs are not allowed on the beds or sofas. No more than two dogs in the hut per visit. Dogs must be well-behaved and under control at all times, any animals found worrying farm animals or farm pets will be restrained by CFSH. CFSH reserves the right to ask owners of badly-behaved or troublesome dogs to leave. An additional charge of £20 per stay is required to cover the cost of additional cleaning.
Wi-Fi
Complimentary Wi-fi is available. CFSH will not be held accountable for any interruption in broadband service.
Complaints
Any complaints must be made known to CFSH immediately so that on-the-spot investigation can be made if necessary and remedial action taken if required. In no circumstances will compensation be made for complaints raised after the holiday period has ended, or when the guest has denied CFSH the opportunity to investigate the complaint and endeavour to put matters right during the holiday period. If the guest is dissatisfied with the way the problem has been handled, the guest must put the complaint in writing to CFSH within 7 days of the end of the holiday.
Advertised Details
CFSH makes every effort to ensure that the information provided is presented accurately on it's website, promotional material and information book in the property. However, details and prices may be subject to change and errors do occasionally occur; it is the guest's responsibility to check all the details and arrangements with CFSH at the time of booking. CFSH cannot accept responsibility for any inaccurate or misleading information given. Sometimes changes to services or facilities at CFSH may occur after the booking has been made and in this instance the guest will be alerted to these changes as soon as possible. CFSH cannot be held responsible for discrepancies resulting from events, which are beyond its control e.g. closure of the public house or if the guest disputes any of the recommendations suggested.
Personal Details
In order to process the booking, CFSH will need certain information from the guest about the party. It may be used for administration purposes solely by CFSH and for sending the guest future promotional or marketing literature. Any information will remain confidential and is protected under the Data Protection Act 1988.
Act of God
The guest and CFSH will not be liable for their respective obligations under this agreement in circumstances amounting to Acts of God. An Act of God means any unusual and unforeseeable events beyond reasonable control, including but not restricted to war, threat of war, civil strife, natural or nuclear disaster, fire, epidemics, terrorist activity or governmental action. The guest and CFSH shall only be able to rely on Acts of God after taking all practical steps to remedy the cause of Acts of God.
Liability
CFSH shall have no liability for any death or personal injury unless this results from the negligence of CFSH. In addition, CFSH accepts no responsibility for the safety of, or the loss or damage to the guest's possessions whilst on CFSH's property or land. Exception to this is if damage or loss is caused by negligence by CFSH or its employees.
Law
The contract between the guest and CFSH is governed by English Law. Any dispute the guest has with CFSH shall be dealt with in an English Court of Law. The guest's statutory rights are not affected by anything contained within these booking conditions.
DECLARATION
I have read the booking conditions and agree on behalf of all members of my party to abide by those conditions. I understand that any balance payment must be paid at least 56 days before the holiday is due to start. I am over 21 years of age.
